Anyone following the court challenges against Joe Biden’s unconstitutional vaccine mandates may feel like they’re watching a ping-pong game. The assignment of this critical case across the spectrum of U.S. Appeals Courts is like watching a Chinese table tennis match.
Even less ironic, a virus spawned these ping-pong challenges to Draconian mandates and decrees. However, for the companies and workers who will suffer painfully from these tyrannical orders, there is no irony.
This recent ruling to uphold the mandate was very indicative of how political Biden’s attempt to sidestep the U.S. Constitution has become. While the 5th U.S. Circuit placed a freeze on similar a mandate, another three-judge panel rendered the most recent decision.
The outcome was a 2 to 1 final vote. A Barack Obama appointee voted on Biden’s side, and a President Donald Trump appointee voted against the mandate. George W. Bush appointee, Judge Julia Gibbons, was the deciding vote. She has the longest-standing tenure of the three.
While a GOP appointed U.S. Circuit judge, Gibbons often refuses to render decisions entrenched in conservative values. Her latest vote was further proof. How the final decision was determined isn’t the only aspect of this ruling that’s important to understand.
What it says is the Occupational Safety and Health Association (OSHA) has the right to exercise mandates to provide emergency protection for the public workforce. This is the key contention by many who strongly oppose the mandates as not only unconstitutional, but unnecessary.
Opponents contend there is no proof of emergency. There’s been no viable evidence to support an “emergency” call for such overreach by a government agency. Most experts believe the case will quickly navigate itself to the U.S. Supreme Court, where it must die its legal death.
What the courts are doing with these unnecessary, and clearly unconstitutional mandates, is to bat them back-and-forth between circuits. The 6th U.S. Circuit ping-ponged the previous order from the 5th U.S. Circuit to freeze the mandate.
Next serve will belong to the U.S. Supreme Court. However, despite rendering a ruling based on facts and logic, the 6th U.S. Circuit ruling did one important thing. Most experts insist this was the ultimate course these mandates were going to follow. Few are surprised.
